Legal expert: Amanda Knox "should stay where she is"

Amanda Knox has said she won't ever return to Italy, but she could have no choice.

Now that an Italian court has reinstated her murder conviction this week in the death of her roommate, Meredith Kercher, it could set up a potentially lengthy extradition battle.

In the meantime, CBS News legal analyst Rikki Klieman said Knox "must be mindful."

"She should stay where she is," Klieman said. "She should stay in the state of Washington. She should never go out of the country."

The case is now on appeal, but Klieman said it's likely that the final appellate court - which sent the case down for the retrial to begin with - is going to convict her.

Whether the U.S. will extradite Knox then becomes "the ultimate political question," Klieman said.

 

'They do not have to send her back," said Klieman. "… I have heard too many experts say, 'Well, of course, we're not going to send her back.' It is not that simple at all. We have extradition treaties with all kinds of countries. We're not going to - while we're looking for Edward Snowden - subtly make a decision politically, or perhaps five years from now, to say, 'Well, this time, we're not sending someone back.'"
