George Zimmerman trial: Instagram photo posted by defense attorney's daughter comes under fire

This Instagram photo, published by the daughter of defense attorney Don West, has drawn controversy. Instagram

Updated 2:36 p.m. (CBS/AP) -- SANFORD, Fla. - Prosecutors are asking a judge in the George Zimmerman trial to conduct an inquiry into an Instagram photo that was posted by the daughter of defense attorney Don West.

The photo shows West with his daughter holding up ice cream cones. The caption reads "We beat stupidity celebration cones."

The photo included the hashtags #zimmerman," "#defense" and "#dadkilledit."

Prosecutors filed the motion Monday in response to a photo defense attorney West's daughter posted last week. The prosecution motion says the photo was posted after West's often tense cross-examination with prosecution witness Rachel Jeantel. West, however, said Tuesday that the ice cream photo was taken a day before Jeantel testified and is unrelated to her testimony. He called the prosecution's motion "irresponsible."

Jeantel was on the phone with Trayvon Martin in the moments before he was fatally shot by Zimmerman during a fight. Jeantel, 19, said that she heard Martin on the phone saying "Get off, get off." In a lengthy cross-examination, West attempted to point out inconsistencies in Jeantel's story, including that she hadn't mentioned the phrase in one of her accounts of the evening's events.

Zimmerman defense team spokesman Shawn Vincent confirmed to CNN the photo came from Don West's 23-year-old daughter, Molly. According to the report, West said in a statement, "Sometimes we're deeply disappointed by the things our children do. But we love them anyway, and we move on."

West also drew fire for beginning his opening statements with a "knock-knock" joke.

Zimmerman is pleading not guilty to second degree murder, claiming self-defense.

Prosecutors say an inquiry is necessary to make sure witnesses are treated with respect.
